This Policy is issued on behalf of Starscream Limited. The terms “Company”, “we”, “us” or “our” in this Privacy Policy refer to Starscream Limited/or the relevant company in the group responsible for processing your data., having it’s registered office in Saint Lucia, with registration number 2023-00007, licensed and regulated in virtue of an interactive games of chance or mixed chance and skill Gaming Services license numbered 00952 issued by the Kahnawake Gaming Commission.

All references to “Player”, “end user”, “you”, “yours” and/or “your”, in this Privacy Policy refers to any user which accesses and plays on Scatters.

The types of information processed by Scatters

 Identity Data: refers to First and Last Name, Date of Birth, Place of Birth, Residential Address (including City, ZIP Code and Country), Nationality, Identity Reference Number or Passport Number, Age

 Contact Data: Username, Phone Number, Postal address and Email Address

 Customer Support Correspondence: When you ask for assistance from our Scatters Customer Support team through Live Chat or the Contact Form, we will collect and store the contact information you provide (generally your name and e-mail address), information about your game play or activity on the Website, and your user ID number.

 Account Limits: You may choose to set limits on your accounts including time, bet and loss limits and daily deposit limits (“Limit Data”).

 Financial Data: You might be required to provide the following “Financial Data” – card number, expiry date, security code.

 Self-Exclusions: You always have this option if you decide to take a break from gambling, whether you just want to restrict your play or if you feel it becomes something other than fun and entertainment. Once you set a Self-Exclusion you will not be able to access it before the chosen time period expires, your account will be subject to your Self-Exclusion restrictions on the brand you have set the Self-exclusion on.

Activity Logs - playing history and activity logs including login session activity: start, end, end reason, start balance, start bonus, end balance, end bonus balance, game sessions, game rounds, total bets, total wins, income and IP address;

Account Balance – total, real and bonus balance, pending withdrawals, pending deposits, reserved bets, income, total deposits, withdrawals, bonuses, average deposit and bonus, and maximum balance;

Technical Data including:

Information about your visit including the full Uniform Resource Locators (URL), games you played and duration of each game and page, page interaction information (“Usage Data”);

Information received from cookies including details of your visits to this site for traffic overview, games you played, duration on each game and in general your behaviour on the website. This information is collected in line with our Cookie Policy (add link) (“Cookie Data”).

Public Sources Data, that represents all the publicly available information from Third Parties or Publicly Available Sources, usually via Google searches.

Marketing communication data: This will include your preference in receiving marketing materials from   Scatters, as well as updates regarding content and new promotions Choosing to opt out from receiving marketing communication will not affect the rest of your relationship with Scatters. If you consent to receiving this information, we will process your name/surname/email address/phone number.

Other data: As a rule, Scatters does not collect or process any kind of sensitive personal data related to:

Scatters has the legal obligation to keep a copy of your gambling history and to employ measures to detect and identify problem gaming using analytical tools and/or behaviour monitoring systems, as well as the legal obligation to take steps to prevent further harm if such an issue was identified. We will also use such data to initiate customer interaction where we have concerns that your behaviour may indicate problem gambling.

 

Scatters will also use and study your Usage Data, Technical Data and Account Data to target marketing activities for persons of the same age as you. This activity includes the processing of your age. We use profiling for the purposes of complying with our anti-money laundering and funding of terrorism obligations. Credit card information processing:

Scatters does not collect your credit card and financial information, as the payment process is done through our payment gateway providers.

Our payment gateway providers use secure server software (SSL - SSL Certificate enables encryption of sensitive information during online transactions), which is the industry standard and among the best software available today for secure commerce transactions.

We do not have access to any information about the card or your bank account, other than the ones you provide for KYC verification purposes, that Scatters will only process in order to comply with legal obligations.

 

Disclosing your Personal Data

Your personal data will be disclosed to certain third parties set out below for the purposes listed in the table above.

Scatters shall only disclose your personal data to third party data processors or consultants where lawful to do so including where we:

Scatters will disclose your personal data to external service providers and third-party vendors, that act as data processors on behalf of Starscream Limited. Your information will always be secure as we obtain guarantees from such third parties to ensure that they process your data in line with the GDPR, to keep your information secure and not to use it for their own purposes. We shall only disclose the personal data which is necessary for such third parties to deliver the required service.

  • Professional advisors including lawyers, compliance officers, auditors and insurers;

 

Scatters may also disclose your personal data in accordance with and to the extent allowed and/or required by the data privacy current laws & regulations.

In the cases when you are disputing payments or losses charged on your account, Scatters shall disclose your KYC Data, Bank Account Data, Usage and Account Data to your bank to settle the dispute.

 Relevant authorities, employees of Starscream Limited., in particular Customer support agents and other employees with relevant roles shall also have access to your personal data for the purpose of executing their duties and providing you with assistance and the service.

 

Data Transfers

We will only transfer your data to the European Union or to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.

 When making a request pertaining to your Data Protection rights, Scatters  might need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or exercise any of your other rights). In order for us to be able to comply with this statutory obligation, we will ask you to provide us with the necessary information and documents and notify us without undue delay of any changes that may arise during the course of the business relationship.

Should you choose not to provide us with such data, we might not be able to enter into or continue our business relationship and fulfil the Terms and Conditions applicable between us and our obligations thereunder as we would be in breach of our anti-money laundering and funding of terrorism obligations.

Reference is made to the Terms and Conditions whereby you have undertaken to provide us with certain personal data, including documentation, and to inform us of any changes to such data. In these circumstances, the provision of personal data is a contractual requirement.
